06. Mediation

MEDIATIONS ARE AN ATTEMPT TO SETTLE A LEGAL DISPUTE

Mediation is a form of alternative dispute resolution (ADR) that attempts to find a solution to a legal problem that suits both parties.  The mediation process involves the participation of a third party who serves as a neutral in the process.  The neutral, often referred to as a mediator, works works to find circumstances that both parties can agree on in an effort to the parties agree upon a fair result.

MEDIATIONS ARE LESS EXPENSIVE THAN COURT

Mediations are often encouraged by attorneys and judges because they provide an alternative to lengthy and expensive litigation in court.  By reaching a negotiated settlement in a mediation, both parties have more control over the outcome of their claim.  Also, mediations save the parties hundreds if not thousands of dollars compared to the cost of pursuing claims in court.

MEDIATION SETTLEMENTS ARE VOLUNTARY

Mediation is usually a completely voluntary process where all parties agree to attempt to reach a resolution to a legal issue.  But even if mediation is court ordered, it is important for both parties to understand that any settlement that may be proposed during the process is completely voluntary.
